1. The contract between us
We must receive payment of the whole of the price for the services that you book, before your order can be accepted. Once payment has been received by us we will confirm that your booking has been accepted by sending an email to you at the email address you provide in your booking/application form. Our acceptance of your booking brings into existence a legally binding
contract between us.
2. Ownership of rights
All rights, including copyright, in this website are owned by or licensed to Thoughtitude. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non commercial use, is prohibited without our permission. You may not modify, distribute or repost anything on this website for any purpose.
3. Accuracy of content
We have taken care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at the time of publishing and that all services have been fairly described.
4. Damage to your computer
We try to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it will not cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website. Except in the case of negligence on our part, we will not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.
All bookings are subject to acceptance and availability. If the course or consultation you have booked is not available we will contact you by e-mail or phone (if you have given us details). You will have the option either to book on the course on an alternative date or to cancel your booking.
6. Booking errors
You are able to correct errors on your booking up to the point on which you click on “submit” during the ordering process.
The prices payable for courses that you book are as set out in our website. Prices for individual consultations, coaching or bespoke training will be supplied by Thoughtitude on initial consultation which will be via skype or telephone.
Please note Special Offers are available throughout the year and only one Special Offer can be used at a time. Special Offers discounting a further course are subject to original courses being paid at the Original Full Price.
8. Payment terms
All deposits are non-refundable and fees paid, either in full or part, are non-refundable unless the course is cancelled. in the event that candidates do not meet the Thoughtitude selection criteria, deposits will be refunded. All course fees must be paid at least 2 weeks prior to the course commencement date and Thoughtitude reserves the right to amend course dates and locations.
These conditions do not affect your statutory rights.
For individual consultations full payment is required before consultation booking is confirmed.
We will deliver any certification due to you at the address you specify on your license agreement. It is important that this address is accurate. Please be precise about where you would like the package left if you are out when we deliver. We cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions
(unless this is caused by our negligence).
You will become the owner of the goods when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.
11. Risk and ownership
Risk of damage to or loss of the goods passes to you at the time of delivery to you, or if you fail to take delivery at the agreed time, the time when we tried to deliver. You will only own the goods once they have been successfully delivered and when we have received cleared payment in full. Goods supplied are not for resale.
12. Acknowledgement and acceptance of your booking
You will need to provide us with your e-mail address and we will notify you by e-mail as soon as possible to confirm receipt of your booking and e-mail you again to confirm details.
13. Cancellation rights
If you are booking as a delegate on our courses and wish to cancel or transfer to another course, the following fees are due
14 Working Days Notice = 50% of Course Fee to Pay
7 Working Days Notice = 75% of Course Fee to Pay
6 Working Days Notice or Less = 100% of Course Fee to Pay
14. Cancellation by us
14.1 We reserve the right to cancel the contract between us if:
14.1.1 we have insufficient delegates to run the course and in this case an alternative date will be offered.
Nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights.
Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to our contact address at Copthorne Hotel Gatwick, Copthorne Way, Copthorne, West Sussex. RH10 3PG and all notices from us to you will be displayed on our website from time to time.
17.Changes to legal notices
We reserve the right to change these terms and conditions from time to time and you should look through them as often as possible.
18. Law, jurisdiction and language
This website, any content contained therein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English law. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.
If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.
21. Intellectual Property
All intellectual property rights, including copyright, patents and design arising In connection with this website and literature shall belong to and remain vested in Thoughtitude.
22. Course Delegate Delegates shall act reasonably throughout the training. Thoughtitude or a Trainer working on behalf of Thoughtitude may remove a delegate from a course, where in the opinion of the trainer, the delegate is behaving unreasonably. Assessments shall take place for delegates on some courses and as such members of the public will be brought in by Thoughtitude to act as clients, these will be named as Thoughtitude clients. At no time during the training, assessment or 6 months after the course shall a delegate solicit or entice a Thoughtitude client for any purposes.
22.2.1 Delegates shall act professionally at all times during assessments and around Thoughtitude clients and must not ask for money, testimonials, other contacts or anything else that would be deemed as unethical or derogatory to Thoughtitude or its agents.
22.2.2 Thoughtitude or its agents will continue with the assessment process by asking the Thoughtitude clients to complete an
assessment form. The information on the form will be treated as confidential and any feedback the Thoughtitude client
would like to feedback via the Trainer, will be adhered to, if not detrimental to any party.
Delegates shall treat and keep all information relating to another party confidential, this is during and after training. Such information should not be divulged to another party (with the exclusion of Thoughtitude Trainers) nor used to the detriment or prejudice of another party.
